Anyone that owned or leased a vehicle, first registered between 2009 and 2020, that was fitted with a defeat device is eligible for this claim. Businesses are eligible to bring claims as well as individuals.

Under English law, businesses may be able to bring claims for;

  • Breach of contract (Sale of Goods Act 1979)
  • Breach of statutory duty in respect of the Emissions regulatory regime
  • Breach of Article 101(1) TFEU

We believe that car manufacturers did not represent themselves accurately while conducting mandated emissions tests.

It is our position that manufacturers used prohibited defeat devices to evade EU and UK regulations. We believe that vehicle owners should be compensated for the following reasons:

  1. The increased Nitrogen Dioxide levels are harmful to children, adults, and the environment
  2. Prohibited defeat devices caused increased vehicle fuel and maintenance costs through improper software.
  3. Vehicle performance during testing was not in line with normal operating conditions because of the prohibited defeat devices.

Fleet management and corporate companies are potentially liable to claims in deceit and breach of contract by their customers. To mitigate this risk, Pogust Goodhead would draft an agreement between our client, the fleet manager or corporate company, and their customer that provides for the customer to surrender potential claims against you in exchange for a percentage of the damages provided by the car manufacturer in exchange for an agreement for the customer to surrender any potential claims against you.

If the case is won, a percentage will be deducted from your compensation costs to cover legal fees, court fees, and our success fee. Unlike some other firms, we cap our fees at a maximum of percentage of damages.

In the event that one or all of the group actions that you partake in not be successful, then as long as you have adhered to the terms and conditions, you will not pay a penny.

We protect you against any costs that Defendant’s may incur by taking out an insurance policy known as After-The-Event (ATE) insurance. This covers all of the costs if the case is not successful.
